Experience Niseko Finnair Competition Terms and Conditions
PRIZE DRAW RULES:
The sponsors of this competition are:
- HTM K.K. – HTM K.K. is the operator of the Experience Niseko website, social media channels and magazine. Experience Niseko aims to promote international and domestic tourism in the Niseko Area. HTM K.K. also manages operations and marketing for the Skye Niseko Hotel.
- Finnair – Finnair is the national airline of Finland, offering domestic and international air travel from its Helsinki base.
By submitting an entry to the Prize Draw, you acknowledge that you have read and agree to be bound by these Official Rules and the decisions of HTM K.K. and Finnair and that you satisfy all eligibility requirements.
The Prize Draw is open to people aged 18 or older at time of entry. Employees of HTM K.K., Finnair, its respective parent, subsidiaries, affiliates, advertising and promotion agencies, distributors, merchants involved with this Prize Draw, and their immediate family members and/or those living in the same household of each are not eligible to enter or win. Prize Draw governed by Japanese law. Prize Draw is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law. No purchase necessary to enter or win. A purchase will not improve your chances of winning.
HOW TO ENTER:
To enter the Prize Draw, follow all on-screen instructions to complete and submit the online entry form (“Primary Entry”). Entrants may enter once only. All entries must be received by Midnight Japanese Standard Time on 30 November 2019 (“Prize Draw Entry Period”).
PRIZES & APPROXIMATE RETAIL VALUES (“ARV”):
The main prize includes two adult return economy airfares flying Finnair from any airport in Europe which Finnair operates to Helsinki then direct to Sapporo (New Chitose Airport), seven nights’ accommodation at Skye Niseko for two people sharing a one bedroom apartment including daily breakfast for two people; free premium ski/snowboard rental for six days for two people; free group ski/snowboard lessons with GoSnow for six days for two people, free six-day, Grand Hirafu-only lift tickets for two people; free return transfers from Sapporo airport to Skye Niseko for two people; two free 60-minute deep-tissue massages at Ryko Spa; one dinner for two people at Kumo Restaurant to the total value of ¥20,000 (Wata Gumo set menu, drinks not included).
Approximate retail value for above: ¥1,280,000. Exact prize value depends on the European city from which the winner is commuting via Helsinki as well as the dates the trip is taken.
If winner is unable to receive the prize then it will be forfeited, and an alternate winner may be selected in accordance with these Official Rules from among the remaining eligible entries for that prize. Prizes may not be transferred or assigned except by Sponsor.
ADDITIONAL TERMS FOR MAIN PRIZE
The prize must be taken between 1 January 2019 and 28 April 2020 or 1 December 2020 and 28 April 2021. Prize is not available between 20 December 2019 and 5 January 2020 or 20 December 2020 and 5 January 2021. For those intending to travel during the winter 2019/2020 season, booking and dates of travel to be agreed with HTM K.K. and Finnair by 30 November 2019. For those intending to travel during the winter 2020/2021 season, booking and dates of travel to be agreed with HTM K.K. and Finnair by 30 September 2020. Booking dates for all prizes are subject to availability. Paid-for extensions to the itinerary should the winner wish to extend his/her stay at Skye Niseko may be possible depending on availability at the hotel. Standard amendments and cancellation fees apply. Travel, meals and beverages other than those stated above, travel to and from the home airport and any other additional expenses are the responsibility of the prize winner.
THE FOLLOWING APPLIES TO THE ABOVE:
Winners will be selected by the marketing team at HTM K.K. having reviewed all eligible entries received. Drawing will be conducted on or about 1 December 2019 and the decision will be final. Winners will be notified by email within one week of the closing date and at the judges’ discretion, will be required to complete and return an email confirmation of prize acceptance and possibly an Affidavit of Eligibility and Liability and a Publicity Release (“Affidavit/Release”) within 7 days of notification, or an alternate winner will be selected. Prize awarded within 30 days after receipt and verification of completed Affidavit/Release or prize notification. If a potential winner cannot be contacted, or if Affidavit/Release is returned as undeliverable or if the selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited and may be awarded to an alternate winner. No substitutions are permitted except if prize is unavailable.
HTM K.K. and Finnair reserve the right to cancel or amend the prize draw and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the prize draw will be notified to entrants as soon as possible by the promoter.
No prize (or part of) is redeemable for cash, tickets or services. Prize is non-assignable and non-transferable except to a surviving spouse. Winner is responsible for all federal, state, local sales and income taxes. Any other incidental expenses on prize not specified herein are the sole responsibility of winner. Entry and acceptance of prize constitute permission to use winner’s name, prize won, hometown and likeness for online posting and promotional purposes without further compensation, except where prohibited by law.
Late, invalid, duplicate or incomplete entries will not be considered, and HTM K.K. and Finnair accept no responsibility for lost entries.
If HTM K.K., Finnair or Skye Niseko goes bankrupt or out of business then the cash value of the prize cannot be redeemed.
Participating entrants agree to these Official Rules and the decisions of HTM K.K. and Finnair, and release, defend and hold harmless HTM K.K., Finnair and their affiliated companies, and all other businesses involved in this Prize Draw, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation, acceptance and use or misuse of prize. Winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Prize Draw or use or redemption of prize. HTM K.K. and Finnair are not responsible for any typographical or other error in the printing of the offer, administration of the Prize Draw or in the announcement of the prize.
HTM K.K. and Finnair reserve the right to amend these rules at any time. If we do this, we will publish the amended prize draw rules and/or specific prize draw rules on the relevant prize draw page.
Winner acknowledges that HTM K.K., Finnair and all other businesses concerned with this Prize Draw and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative the quality, conditions, fitness or merchantability of any aspect of prize.
HTM K.K. and Finnair are not responsible for inaccurate prize details supplied to any entrant by any third party connected with this prize draw.
In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the “Authorized Account Holder” of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted e-mail address. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) lost, late, misdirected, damaged, illegible or incomplete entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Prize Draw.
By participating in the Prize Draw, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsors, which are final and binding in all matters relating to the Prize Draw. Failure to comply with these Official Rules may result in disqualification from the Prize Draw. HTM K.K. and Finnair reserve the right to permanently disqualify from any sweepstakes they sponsor any person they believe has intentionally violated these Official Rules and cancel the Prize Draw if it becomes technically corrupted (including if a computer virus, bot or system malfunction inalterably impairs their ability to conduct the Prize Draw), and to select winner from among all eligible entries received prior to withdrawal. Legal Warning: Any attempt by an individual, whether or not an entrant, to deliberately damage, destroy, tamper or vandalize this website or interfere with the operation of the prize draw is a violation of criminal and civil laws and HTM K.K. and Finnair reserve the right to seek damages and diligently pursue all remedies against any such individual to the fullest extent permitted by law.
ARBITRATION:
This Prize Draw shall be governed by and interpreted under the laws of Japan. Without regard to its conflicts of laws provisions. By participating, entrants agree that any and all disputes arising out of or relating in any way to this Prize Draw shall be litigated only in courts sitting in Sapporo, Hokkaido, Japan.
